Terms of Service

1. Services Provided

1.1 Description: On Route Photography (hereafter referred to as "Photographer") agrees to provide photography services as agreed upon with the client.

1.2. Scope: The services may include but are not limited to:

- Portrait Photography

- Dance Photography

- Event Photography excluding weddings

- Product Photography

- Optional Prints

2. Payment

2.1. Fees: The client agrees to pay the Photographer the agreed-upon fees for services rendered.

2.2. Deposit: A deposit of 25% is required to secure the booking, with the remaining  balance due 1 day before or in agreed upon cases, on the day of the event/shoot. This excludes mini sessions as the full amount is due upon booking.

2.3. Additional Costs: Any additional costs incurred during the provision of services (e.g., travel expenses, accommodation, props) will be borne by the client.

3. Cancellations and Rescheduling

3.1. Cancellation by Client: The client may cancel the booking up to 3 days before the event/shoot,however, the deposit will be forfeited unless otherwise agreed upon.

3.2. Cancellation by Photographer: In the unlikely event that the Photographer is unable to perform the services, all fees paid by the client will be refunded.

3.3. Rescheduling: In the event of Rescheduling, Photographer will use reasonable efforts to accommodate Client’s change. If Photographer is not able to accommodate Client’s change despite using reasonable efforts, the parties agree that such Rescheduling will be deemed as Cancellation by Client and that Photographer will be under no obligation to perform the Services other than on the original date of the Services.

 

4. Rights and Usage

4.1. Ownership: The Photographer retains all rights to the photographs taken during the event/shoot, including copyright.

4.2. Usage: The client agrees that the Photographer may use selected images for promotional purposes, including but not limited to website, portfolio, social media, and advertising.

5. Client Cooperation

5.1. Cooperation: The client agrees to cooperate with the Photographer and provide necessary information and assistance to enable the Photographer to fulfill the agreed services.

5.2. Venue Access: The client is responsible for obtaining any necessary permissions, permits, or access to shooting locations.

6. Liability

6.1. Limitation of Liability: The Photographer will not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the services provided.

6.2. Damages: The Photographer's liability for any direct damages arising out of the services provided shall be limited to the fees paid by the client.

7. Miscellaneous

7.1. Entire Agreement: This agreement constitutes the entire understanding between the parties and supersedes any prior agreements or understandings.

7.2. Governing Law: This agreement shall be governed by and construed in accordance with the laws of Texas.

8. Acceptance

By booking the services of the Photographer, the client agrees to all terms and conditions stated above.
